A former St. Germain man, Michael Fabian, was bound over for arraignment after a preliminary hearing in Vilas County court Monday.

Fabian, 51,  entered a not guilty plea to a charge of homicide by intoxicated operation of a motor vehicle last May 26 in Arbor Vitae that took the life of Kelly Sleeman, 43, of Arbor Vitae.

At the preliminary hearing, District Attorney Martha Milanowski had deputy Jacob Hodgdon describe what he saw when he arrived at the accident.

“I observed a male ejected and laying partially under the overturned vehicle and a female passenger that needed to be extricated,” Hodgdon said. “There was  a vodka bottle next to the vehicle and a bottle of rum in the vehicle almost completely empty.”

Both persons were taken to Howard Young Medical Cener and then to Aspirus Hospital in Wausau. Sleeman died the next day due to her injuries.

A subpoena was obtained and the records at Howard Young  allege Fabian had a blood alcohol level of 0.16% or twice the legal limit.

He is paralyzed from the waist down due to the accident and is now living in Beaver Dam. He faces a maximum penalty of 25 years in prison. The case will continue March 5 with a pre-trial conference with the district attorney.
