Court Appearance Set For Former St. Germain Man Charged In Death

An October court date has been set for a former St. Germain man, Michael Fabian, 51,  for a bond hearing on a charge of homicide by intoxicated operation of a motor vehicle.

Fabian, now living in Columbus, Wis with his son, is the alleged driver of a vehicle accident last May 26 in Arbor Vitae. Court documents indicate Fabian was ejected from the vehicle and a female passenger was pinned inside. Both were transported to Aspirus Hospital in Wausau which alleges Fabian had a blood alcohol of 0.16.

The hospital reported the female passenger died on May 27.

Fabian, appearing by phone, pled not guilty to two traffic citations but has not engaged an attorney. The homicide charge carries a maximum penalty of 25 years in prison, a $100,000 fine and loss of driving license for up to five years.

Assistant District Attorney David Breedlove told the court Fabian needs to appear in court for bond to be set. “He is paralyzed from the waist down and therefore doesn't represent a threat to the public,” Breedlove said.

The court scheduled  Oct 15 for an ajdourned initial appearance when bond will be set.
