Carlin Club Appeal Filed in Vilas County Court

An appeal was filed last Friday in Vilas County court by Carlin Club Properties of Presque Isle requesting the court to overturn a decision by the Vilas County Board of Adjustment denying a permit to transport water from an existing well to Superior Springs, LLC bottling facility in Michigan.

Zoning Administrator Dawn Schmidt denied Carlin Club a permit last May to remove water stating “The physical activity of removing large qunatities of water . . . and transporting it for packaging in another location as a product for commercial sale reflects an entirely different use than a bar, lodging, and restaurant facilities.”

In 1997 the properties around Carlin Lake were rezoned from General Business to R-1 Residential but the operation of Carlin Club were allowed to continue as being “grandfathered.”

The Board of Adjustment, after a three hour hearing July 18, upheld Schmidt's interpertation and denied the appeal.

The civil complaint asks the court to review the interpertation and challenges the decision of the Board of Adjustment, asking the court to reverse the decision.
