Phelps Business Fined For Zoning Violations

Zoning violations in Phelps have resulted in a $2,500 fine to the property owner recently with additional costs as high as $15,000 or higher should the violations not be corrected by August 2.

Deitmar Busch was alleged to have operated a junk/salvage yard on his property and storing items within 50 feet of the center line of Highway 17 at 2198 Highway 17.

Originally scheduled for a court trial, Busch agreed to a “Stipulation for Abatement” to remove all used fuel and oil, remove all but two unlicensed operative vehicles including but not limited to boats, automobiles, trucks, snowmobiles, ATV's and parts thereof. He must also remove all inoperable vehicles and equipment, trailers, snowmobiles, tractors, lawn mowers, boats, ATV's, trucks, and parts thereof. Also required to be removed are all household furnishings and appliances, all salvage material, scrap metal, used tires, and all items and vehicles from the highway setback area.

Busch is required to provide the Vilas County Zoning office with copies of all documents in his possession that establish ownership of boats and other vehicles on his property. He cannot place any items or vehicles removed on another Vilas County property unless placement complies with the Vilas County zoning ordinance; and he cannot burn any trash or hazardous material on the property Finally, should Busch fail to comply with all the items in the stipulation signed by Vilas County Judge Neal Nielsen by August 2, 2019, Vilas County has the authority to enter the property and abate the violations.

Within 30 days of abatement he shall pay Vilas County the greater of the sum of $15,000 or the cost of abatement, whichever is greater.
