A Price county judge hearing the case of Rhinelander's former city administrator will take more time to decide whether to dismiss the case.
Former Administrator Daniel Guild is charged with felony Misconduct in Office and Fail To Perform Known Duty. He was arrested after a months-long investigation by the Oneida County Sheriff's Department.
In court via Zoom Thursday, Guild's attorney Kevin St. John first asked Judge Kevin Klein to dismiss the case, saying the state failed to find sufficient evidence to justify the charges. The case centers on records requests and Guild's duties...
"The office of City Administrator does not need to fulfill the records requests and those records requests were not actually denied. These indicate separate elements of this conversation. They serve as alternate basis for dismissal..."
District Attorney Micheal Schiek argued the case should proceed, saying he felt they had proof to move forward and was ready to present evidence. A problem is the large amount of documentation, what is said to be a thousand pages.
Schiek said he also wanted to supplement the text the defense is offering.
Judge Klein said recent document submissions and the volume of material left him wanting to postpone a decision until he could go through it all...
"I'm certainly willing to agree to a longer period of time for Mr. Schiek to present what we will call a supplemental argument..."
Klein gave the parties up to 30 days to work out the paperwork before making a decision on whether the case should be dismissed.
Guild was placed on administrative leave, then his contract was terminated by the Rhinelander city council.
