The former Rhinelander City Administrator could get charges against him dismissed if he doesn’t break any criminal laws for the next three months.
Daniel Guild is facing a felony charge of misconduct in office. His arrest last March followed an investigation by the Oneida County Sheriff's Department regarding open records requests.
In Oneida County Court on Friday, a Deferred Prosecution Agreement signed by both the Oneida County District Attorney and Daniel Guild was filed.
The document states Guild can get the charge against him dismissed with prejudice if he follows the requirements and conditions in the agreement.
During the period starting February 5 through May 6, 2021, Guild has to follow the terms and conditions of his bond. He also has to “refrain from any conduct which would constitute a violation of the criminal laws”.
During this timeframe, the charge against Guild is suspended and deferred.
If Guild violates any terms of the agreement, the DA can rescind or change the agreement, change the period of deferment, and/or resume prosecution.
There is a review hearing set at the end of the agreement period on May 6.
