Oneida County Jury Deliberating Tran's Fate

The Oneida county jury hearing the case of a woman whose step-son died in her care is contemplating her fate.

Final arguments by both the prosecution and defense wrapped up Thursday noon hour in the case of 30 year old Ellen Tran.

Ellen Tran is charged with first degree reckless homicide in Avery Edward's death. Ellen Tran told law enforcement the boy fell in the shower. The official cause of death is listed as blunt force trauma to the head. Tran was home alone with Avery and two other children when the incident occurred. She called for help and the child was eventually transported to a Marshfield hospital where he died. If convicted, Tran faces up to 40 years in prison followed by 20 years extended supervision.

The father, Trung Tran was arrested in September 2017 and is charged with child abuse, failing to prevent bodily harm and neglecting a child. If convicted of both felonies, he faces a maximum of 18 years in prison and 13 years of extended supervision.
